2009 First time homebuyer tax credit – what is it, how much is it, and how to get it

Its $15,000. No its $7,500. No its $8,000. It has to be repaid. No it doesn’t. Its available to all homebuyers. No the tax credit is only for first time homebuyers. Is this a 2009 version of Abbot and Costello’s Who’s on first, What’s on second, I don’t know’s on third?

All this leads to only one place. The place of mass confusion which is why I have held off on writing a post about the new version of the homebuyer tax credit. That is until all the back and forth haggling was done and our President signed the $787 Billion Economic Stimulus Bill (known as the “American Recovery and Reinvestment Act of 2009″) into law.

first-time-home-buyer-tax-creditAnd after reviewing the 1,091 page bill now turned into law, I am excited to say a tax credit for homebuyers did make it into the final version. The credit is not as large as the National Association of Realtors was hoping but a credit at least survived.  The big advantage the homebuyers tax credit in the American Recovery and Reinvestment Act of 2009 has over the 2008 Housing and Economic Recovery Act is the tax credit does not have to be repaid. 

One small disclaimer … when I said I reviewed the 1,091 page bill, I did not review the entire bill just the sections that pertained to the homebuyer tax credit.

    My wife and I signed papers on our first house in December 2007. Can we qualify for this tax credit if we apply for an amended return?

    Joshua: If by signing papers on your first house you mean you closed on the house in December 2007, the answer is no. You are not eligible for the 2009 first time home buyers tax credit.

    Unfortunately, you are not eligible for the 2008 first time home buyers tax credit either since the effective dates are for homes purchased between April 9, 2008 and December 31, 2008.

    My husband and I built a home this year, however my husband owend a mobile home. No morgage for 3ys or more. Will we still get a tax break?

    Stacie, if the mobile home your husband owned was your primary residence then the answer is No. You are not eligible for the first time homebuyers tax credit. You can read more about the eligibility requirements at http://www.irs.gov.

    My wife and I bought our first house in July. I was planning to claim the tax credit on our 2009 tax return, but a co-worker told me todat that I have to have something filed by October 20th. This is the first I’ve heard of this. Are you familiar with any sort of October 20th deadline?

    I have not heard of any such deadline and the IRS.gov site does not reference any Oct.20 deadline. I think your co-worker is confused
